Slip and Fall down

In the State of Georgia the odds are stacked against victims of a slip and fall down injury. The laws favor the insurance companies.

In a recent case, my (Attorney Peter Pearson) client was a grandmother who loved to cook and crochet. She made all sorts of crocheted crafts for family and friends and also was able to supplement her retirement income by selling some of what she made.

On the day of her fall my client was walking from her car to her son’s apartment building. As she stepped up from the parking lot to the curb she fell and badly fractured her dominant arm. Despite surgery she was not able to return to her crocheting. She lost much of the use of her dominant arm. She had to learn to cook one handed and groom herself one handed. Nor was she able to adequately care for her live in step-mother, who had special needs.

For nearly five years after her fall the apartment complex refused to pay our client one dime – saying it was her fault. After a trial and an appeal, we proved that what had really happened was that the apartment complex had cut a hole in the curb to allow rain water to drain off the landscaping at the complex and THEN their landscaping company had come along and covered the whole section of curb with pine straw. Our client stepped up on what looked like a flat and solid surface, but unbeknownst to her she was into a hidden hole.
