Wrongful Death

As I listened to my client, my heart broke.

It was the first time I talked to the widow of a man who died after falling through a hidden floor hole. One moment he was on a customer’s job site doing his best to fix a piece of equipment, the next he was plummeting down to his death. No warning, no way for him to know his next step would be his last. In that horrible instant, his wife lost her husband, his children lost their father, and as I listened I could see the grief and sorrow on this dear woman’s face.

We worked for the family of this man for 5 years – it was a bitter fight with the defendants until the very end. The defendants responsible for the hole, despite having been fined by OSHA for failing to properly cover the hole, defended the case by blaming everyone and everything else (including the man who was killed by their carelessness).

Time and time again our firm heard from the defendants telling us they were innocent and that they would never pay more than a tiny amount to settle the case. We responded with indignation. After several appeals and going through two trial judges on the case, we won! The defendants had to eat their words – they ended up paying roughly ten times what they had insisted was their “top offer.”

When a loved one has died it is hard enough to deal with their absence. It becomes so much harder when the person or company that caused their absence refuses to accept responsibility. It is our desire to help you hold the at-fault party accountable so that they do not hurt any one else.
